It also will protect the Black Lung Disability Trust Fund against assuming the liabilities of bankrupt coal mine operators.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The final rule also includes the following changes:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Reduces the required security amount of an operator\u2019s liability from 120% to 100%.<\/li>\n\n\n\n<li>Provides option for operators to phase in their increased security requirement.<\/li>\n\n\n\n<li>Streamlines the process for operators to appeal OWCP\u2019s self-insurance determinations.<\/li>\n\n\n\n<li>Allows operators currently securing liabilities with 501(c)(21) trusts to continue to do so, with improved monitoring.\u00a0<\/li>\n\n\n\n<li>Prevents the establishment of new trusts after the rule\u2019s publication.\u00a0<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis final rule will give greater transparency and clarity for mine operators about the procedures and standards for obtaining self-insurance authorization,\u201d said Office of Workers\u2019 Compensation Programs Director Christopher Godfrey.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis will ensure that mine operators, not taxpayers, bear responsibility for benefit payments under the Black Lung Benefits Act, as Congress intended.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The <a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/12\/12\/2024-28848\/black-lung-benefits-act-authorization-of-self-insurers\"><strong>rule<\/strong><\/a> becomes effective January 13.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Source: <\/em><a href=\"https:\/\/www.dol.gov\/\"><em>Department of Labor<\/em><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The U.S. Department of Labor\u2019s Office of Worker\u2019s Compensation Programs has issued a final rule revising the regulations under the Black Lung Benefits Act related to self-insurance by coal mine operators.
